We were given some paper work to fill out for him to take to the interview with him. The form is DS230 Parts 1 and 2. question number 40 part H talks about if you are a part of any group that is ineligable for a visa. it list a ton of examples including one that ask if you were in the united states illegally for more then a year?? My husband was but then willing surrender and went back so that he could get his visa and be here with me and our two boys legally. His waiver I601 has been approved which is grounds for inamisability. So should I answer yes or no to this question.

My husband has his last interview for a visa to come back legally to the united states.
